1. Acceptance of terms
By accessing or using the Epineone platform, SDK, APIs, datasets or documentation (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The Service
Epineone provides a platform that generates synthetic datasets using machine-learning models for the purpose of training, validating and testing third-party AI systems. The Service is provided on a subscription basis under the plan you select.
3. Your data and content
You retain ownership of any seed data, schemas, prompts or configuration ("Customer Content") you submit. You grant Epineone a limited, non-exclusive licence to process Customer Content solely to provide the Service. Synthetic outputs generated for you are yours to use, including in commercial products.
You must not submit Customer Content that you do not have the right to use, or that violates applicable law (including data-protection law).
4. Acceptable use
You agree not to use the Service to (a) re-identify individuals from any dataset, (b) generate content intended to deceive, defame, or harm a specific person, (c) build models that violate applicable law, or (d) reverse-engineer, resell or sublicence the Service without our written consent.
5. Fees and billing
Paid plans are billed in advance on the cadence indicated at checkout. Fees are non-refundable except as required by law. We may change pricing on renewal with at least 30 days notice.
6. Confidentiality
Each party will protect the other's confidential information using at least the same care it uses for its own confidential information, and not less than a reasonable standard of care.
7. Warranty disclaimer
The Service is provided "as is". Epineone disclaims all warranties, express or implied, to the maximum extent permitted by law. Synthetic data is intended for model development and is not a substitute for clinical, legal or safety decisions made on real individuals.
8. Limitation of liability
To the maximum extent permitted by law, Epineone's aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the 12 months preceding the event giving rise to liability. Neither party is liable for indirect, incidental or consequential damages.
9. Termination
Either party may terminate for material breach not cured within 30 days of written notice. Upon termination, your right to access the Service ends and we will delete Customer Content within 30 days, subject to legal-retention requirements.
10. Governing law
These Terms are governed by the laws of France. Disputes will be brought before the competent courts of Paris, France, unless mandatory consumer-protection rules in your jurisdiction provide otherwise.
